Terms of service for the contact form
These "Terms of service for the contact form" set out the rules for the free use by Users of the contact form available on the website of Manor Park Wilanów Spółka z ograniczoną odpowiedzialnością, for the purpose of preparing responses to enquiries, including those containing commercial information. These Terms fulfil the obligation referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of services by electronic means.
1. Definitions
- Controller – Manor Park Wilanów Spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw, ul. Belgradzka 4 lok. 64, 02-793 Warsaw, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS no.: 0001097526, REGON: 528222772, NIP: 5243002680, processing the personal data of users of the Manor Park Wilanów website.
- Website – the Controller's website dedicated to the Manor Park Wilanów development.
- Contact form – a form enabling an electronic message to be sent to the Controller, in which Users of the website provide the information and data necessary to perform the service / handle the enquiry submitted. Through the form the Controller also provides information services that allow the User to learn about its offer.
- User – a person using the Contact form within the scope provided for in these Terms.
- Terms – this document.
- Service – the Contact form service.
2. General provisions
- The Terms set out the rules for the Controller's provision of the Service by electronic means.
- Before consenting to use the Services, you should read the Terms.
- To use the Services, the User must have a computer or another multimedia device with access to the Internet, any web browser, and an active e-mail account.
- Use of the Services is voluntary. Access to the Service is not conditional upon the User fulfilling any formalities; in particular, it does not require the User to register or log in.
- The Services may be used by any person who is at least 18 years old.
- Provision of the Services will begin immediately after the User activates the Service in accordance with the Terms.
3. The contact form service
- The contact form allows the User to send an electronic message to the Controller and is used solely for correspondence related to the Controller's activities.
- The Controller provides Users with free access to the Contact form Service for an indefinite period.
- To use the Contact form Service, the User performs the following: reads the Terms and accepts all of their provisions; completes the Contact form by providing the following data: full name, e-mail address, telephone number, message content; consents to the processing of personal data for the purpose of providing the Service; optionally consents to receiving marketing and commercial information by electronic means and/or via terminal telephone devices; confirms the wish to use the Service by clicking the "Send" button.
- The User is obliged to use the Contact form Service in accordance with the law, the provisions of these Terms and good practice.
- The User undertakes not to provide false personal data, nor the personal data of another person without their permission, nor an e-mail address they do not own. The User bears sole responsibility for the content of the data they provide.
4. Deactivating the service
- The User may deactivate the Contact form Service at any time.
- To deactivate the Contact form Service, send a message to the Controller's e-mail address: rodo@manor-park.pl.
- The Contact form Service may also be deactivated at the Controller's initiative if the User fails to comply with the obligations required by the Terms.
- Upon deactivation of the Contact form Service, the Controller will stop sending messages and offers to the User's e-mail address.
- The User may re-order the Contact form Service at any time.
5. The Controller's liability
- The Controller is not liable for any unavailability of the Contact form Service resulting from causes beyond the Controller's control or other technical reasons related to the operation of the Controller's ICT system and website.
- The Controller reserves the right to amend the provisions of these Terms at any time. Changes take effect upon publication of the amended Terms on the Controller's website.
- The User undertakes to familiarise themselves with changes to these Terms.
- The Controller reserves the right to cease offering this Service entirely at any time, without giving reasons.
6. Complaints
- Users may submit complaints concerning the non-performance or improper performance of the Service.
- A complaint should include: the contact details of the person submitting the complaint, necessary for sending a response, and a description of the irregularities in the Service together with the expectations regarding its resolution.
- Complaints will be considered by the Controller within 14 days.
- The Controller will promptly notify the person submitting the complaint of the decision via e-mail to the address provided in the complaint or by registered letter to the address indicated in the complaint.
7. Final provisions
- Users' personal data are processed on the basis of consent given by the data subject by ticking the appropriate box on the Contact form. Detailed information on the processing of personal data is provided later in this document.
- The invalidity of one of the provisions of the Terms, as established by a ruling of a competent court, does not render the remaining provisions of the Terms invalid.
- All matters not regulated in these Terms are governed by the provisions of applicable Polish law.
- Any disputes arising from the use of the Website, including the provision of the Service, will be resolved by a Polish common court.
Privacy policy for the service provided electronically — online contact form
I. Data controller

Belgradzka 4 lok. 64, 02-793 Warsaw, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS no.: 0001097526, REGON: 528222772, NIP: 5243002680. The data controller can be contacted:

II. Purposes, legal bases and duration of data processing
1. Responding and handling the matter. The content of the correspondence and the contact information are processed for the time necessary to handle the user's matter, including sending marketing information about the products or services you have selected, and for no longer than 3 months after the matter has been handled, for archiving purposes in case it becomes necessary to defend against potential claims against the controller. These data are processed on the basis of consent for the purpose of providing the online contact form service by electronic means (Article 6(1)(a) GDPR). With respect to sending commercial information by electronic means or direct marketing via terminal telephone devices, the data are processed on the basis of consent expressed by a clear affirmative action (Article 6(1)(a) in conjunction with Article 4(11) GDPR).
2. Pursuing claims. Where it becomes necessary for the controller to pursue claims or defend against claims, the controller may process the personal data of specific users contained in the online contact form until the conclusion of the relevant proceedings and until the expiry of the limitation period for the controller's claims against the user, which is usually 3 years pursuant to Article 118 of the Civil Code but, in special cases provided for by law, may be longer. These data are processed in accordance with Article 6(1)(f) GDPR, i.e. in the controller's legitimate interest.
3. Service usage statistics. In order to improve the quality of its services, the controller processes statistical information on the use of the online contact form, using statistical information provided by cookies or other similar technologies. These data are processed in accordance with Article 6(1)(f) GDPR in the controller's legitimate interest, consisting in facilitating the use of the services and improving the quality and functionality of the services provided. These data are processed as part of the controller's ongoing activities, but for no longer than 60 days from receiving the information.
III. Recipients of users' data
- The personal data contained in the online contact form are disclosed solely to entities processing data on behalf of the controller on the basis of a written data processing agreement, providing, among others, hosting or website maintenance and IT services.
- Your personal data will not be transferred to third countries, i.e. countries based outside the European Economic Area.
IV. Rights of data subjects
Every data subject has the right:
- of access – to obtain confirmation from the controller as to whether their personal data are being processed and to obtain access to them and information about the processing (Article 15 GDPR);
- to receive a copy of the data – to obtain a copy of the data being processed (Article 15(3) GDPR);
- to rectification – to request the rectification of inaccurate data or completion of incomplete data (Article 16 GDPR);
- to erasure – to request the erasure of their personal data if the controller no longer has a legal basis for processing them (Article 17 GDPR);
- to restriction of processing – to request the restriction of the processing of personal data (Article 18 GDPR);
- to data portability – to receive the data in a structured, commonly used, machine-readable format (Article 20 GDPR);
- to object – to object to the processing of their personal data for the controller's legitimate purposes (Article 21 GDPR);
- to withdraw consent at any time and without giving reasons, whereby processing carried out before the withdrawal of consent remains lawful.
To exercise the above rights, the data subject should contact the controller using the contact details provided and inform the controller which right they wish to exercise and to what extent.
V. President of the Personal Data Protection Office
The data subject has the right to lodge a complaint with the supervisory authority, which in Poland is the President of the Personal Data Protection Office, based in Warsaw, ul. Stawki 2, who can be contacted: by letter (ul. Stawki 2, 00-193 Warsaw), via the electronic inbox available at https://www.uodo.gov.pl/pl/p/kontakt and by telephone: (22) 531 03 00.
VI. Legal acts referred to in this clause
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;
- Article 118 et seq. of the Act of 23 April 1964 – the Civil Code.
